The POCSO Act, which lays down the minimum punishment for aggravated penetrative sexual assault, has a broader definition now than it did before. For example, an act that is classified as ‘penetrative’ is considered aggravated if it is performed with an intent to cause harm to the victim. Under the POCSO Act, the offender must serve a minimum of 10 years in prison. However, under the new legislation, the maximum punishment will be life in prison.
In the Netherlands, marital rape is an aggravated sexual assault, while it is not a felony in most jurisdictions. In India, the POSCO Act contains provisions for aggravated penetrative sexual assault against children. The Indian Penal Code also defines this offense and defines the circumstances under which it may be committed. Unlike other forms of sexual assault, aggravated penetrative sex assault can involve multiple victims, use of a deadly weapon, or even a sex offence.

Aggravated Penetrative Sexual Assault
Aggravated penetrative sexual assault is defined as sexually touching a child’s vagina without consent, performing an act on an intoxicated or incapacitated victim, or using an improper medical method to perform an act on the child. The law requires that the sexual activity is performed with another person and that the attacker is armed with a deadly weapon. While a convicted offender must spend at least 10 years in prison, the maximum sentence under Section 6 is life in prison.
The definition of aggravated penetrative sexual assault is extremely broad. It can include acts of a felony nature or multiple people. The perpetrator must also be at least 18 years old and have the intention to commit a violent crime against the victim. In some cases, the offender has a child in tow and the attacker uses a deadly weapon. A convicted offender can be jailed for aggravated penetrative sexual assault in several states.

The accused is usually sentenced to seven years in prison. A victim can be convicted of aggravated penetrative sexual assault if they are a public servant or police officer.
