Disabled People Are Discriminated Against
The Equal Employment Opportunity Commission recently released statistics regarding workplace discrimination. They found that the number of discrimination complaints rose last year and that disability-based discrimination is on the rise. About 30 percent of charges involved disability discrimination. This is high considering that people with disabilities only make up 20 percent of the population. This is concerning because these statistics highlight the need to improve workplaces that are hostile to disabled workers. To combat workplace discrimination against disabled people, it is crucial to educate employers about disability rights.
Disability discrimination comes in many forms. Direct discrimination refers to instances where disabled people are treated less favorably than others. For example, a restaurant might allow a disabled child to dine outdoors while denying him or her the option of dining in the family room. Because the child is disabled, the family is denied the same options as other families. If this is the case, the restaurant is most likely guilty of direct discrimination.
Employers lose out on growth if they don’t allow their employees with disabilities to participate fully in the workforce. When employees are prevented from contributing their ideas, they aren’t as productive. In the United States, millennials make up 33 percent of all employees with disabilities, while Gen-Xers and baby boomers make up twenty-seven percent. While these statistics may seem small, they’re indicative of the need to improve workplaces for people with disabilities.
The latest data on disability employment shows that millennials are the first generation to go to college and school under the American with Disabilities Act. The higher numbers are linked to a higher diagnosis rate of previously undiagnosed disabilities. Disabled people are more ambitious than their non-disabled counterparts, and many report feeling “stalled” because they can’t do their job. So a higher percentage of people with disabilities report feeling discriminated because they’re disabled.
How Many Disabled People Are Discriminated Against at Work?
The EEOC has published a range of fact sheets, guidance documents, and other materials that provide employers with helpful information about the rights of disabled workers. These documents outline a person’s legal rights, which are meant to protect them from discrimination and abuse. However, there are many exceptions to these laws and employers should review the rules thoroughly before implementing any changes. If they fail to make the necessary adjustments, they’re not responsible for the discrimination.
Fortunately, the American Disabilities Act prohibits discrimination against people with disabilities in the workplace. The Bureau of Labor Statistics found that disabled workers have lower employment rates than their non-disabled counterparts. According to this study, only 19.3 percent of people with disabilities were employed in 2018, compared to 66.3% for those without disabilities. However, many disabled people report that they had trouble getting an interview and even were turned down for a job due to the fear of being discriminated against.
In addition to these cases, the ADA also protects disabled individuals from certain prohibited acts. Employers can also refuse to hire a disabled person if they feel the person would pose a direct threat to their health or safety in the workplace. Whether or not the employer makes a reasonable accommodation is not the point of this law. The question is, how many disabled people are discriminated against? While this might seem like a trivial matter, it is an important question that should be answered.
